入管法の改正 2012年7月9日

 

Change of the Immigration Law

 

at July 9, 2012

 

2012年7月9日に入管法の改正が行なわれますが、その骨子は以下の通りです。

1.　在留カードが交付されます。

2.　在留期間が最長5年となります。

3.　再入国許可制度が変ります。

4.　外国人登録制度が廃止されます。

 

Outline of the change of Immigration law on July 9, 2012 is as follows.

 

1. Zairyu-card will be introduced.

2. Length of stay will be 5 years at longest.

3. Re-entry permission will be changed.

4. Alien registration will be abolished.

●１．入国した際に在留カードが交付される。（住所の欄は空欄）在留カードは常に携帯義務がある。パスポートには上陸の証印が押される。

短期滞在には、在留カードは発行されない。

 

Zairyu-card is issued at the time of landing to Japan.

There is obligation to keep it anytime in Japan.

Landing stamp is sealed on a passport.

No Zairyu-card is issued for temporary visitors. 

 

●２．最初の在留カードの写真は、COEの写真が使われる。

 

COE’s picture is used for the picture of Zairyu-card.

  

●３　更新、変更にも写真が必要（16歳未満は写真必要ない。）

また、申請には常に在留カードを添付しなければならない。

Picture is needed at renewal or change of visa. (Under 16 years old---Not needed)

Zairyu-card is needed at renewal or change of visa.

 

2012年7月9日以降最初の更新、変更の時まで外国人登録証は、在留カードとみなされるが、外国人登録証のままだと、それを在留カードに変更しなければならない関係上、更新、変更の許可をもらうときは、最終的に外国人登録証を入管に持参しなければならない。

 

Alien registration card is regarded as a Zairyu-card until the first renewal or change after July 9, 2012

Alien registration card must be returned at the renewal or change.

永住者は3年以内、16歳未満は3年以内又は16歳の誕生日いずれか早い日までに在留カードを作成しなければならない。

 

Length of valid term of Zairyu-card

Permanent resident ---3 years

Under 16---3 years or birthday of 16, earlier

 

 

在留カードをコピーして外国人に渡して、行政書士が在留カードを持参して申請する。

 

The lawyer can bring Zairyu-card to the Immigration.

(Copy must be given to the applicant.)

 

●４．更新、変更申請には写真が必要

 

Picture is needed for the application of renewal or change

 

●５．日本で住所を定めたら、区役所で住所を届けなければならない。（その際には在留カードを持参しなければならない。－委任状が必要

14日以内に届けないと罰金

届け出には在留カードと届け出書のみでＯＫ

上陸後、90日以内に届けないと、在留資格の取消しの対象となる。

 

Address must be reported to City office in 14 days.

(If not, punishment money, 200,000 yen.)

Zairyu-card is needed for the report.

The visa status will be cancelled and the resident will be deported, if the address is not reported in 90 days.

 

虚偽の住居地を届け出ると、懲役刑の対象になり、退去強制の可能性がある。

 

False address report is the cause of punishment and deportation.

 

●６　在留カードの情報は、入管局のウェブサイト通り。

（住所以外の情報が変更となったら再交付される。）

 

The information in Zairyu-card is as Immgration's website.

(The Zairyu-card will be issued again if the information excluding address is changed.)

 

●７　漢字は日本の正字

Japanese Chinese-Character is used.

 

●8　住所の変更･･･区役所　　　勤務先の変更･･･入管

　　離婚・・・入管

　　各々14日以内、届けないと罰金20万円

 

　To where must residents report?

   Change of address---City office

   Change of employer—Immigration

   Divorce---Immigration

   They must be reported in 14 days. (punishment money 200,000 yen)

住居地の変更は、同時に住民票の変更をすることとなる。（転出地と転入地）

 

The change of address must be reported to the old and new city office together.

●9　現在在留中の者は、在留カードの発行の申請ができる。

The resident can apply for the issue of Zairyu-card.

 

 

●１0　所属機関も雇用保険の届け出をしないところは、届け出をしなければならない。（学校等）

 

The organization (like Schools) must report entry and quit of the students.

Employer also report if it does not report by Employment insurance.

 

●１1　離婚後、6月以上、配偶者の活動を行わない。

90日以上、住居地の届け出を行わない。在留資格の取消

（これまでは、3月以上、就労していないと、取消）

 

Visa is cancelled  

6 months after divorce

3 months after retirement

90 days of not report of address

 

●１2　在留期間の最長は5年

   Longest term of visa is 5 years

 

 

みなし再入国許可

Deemed Re-entry permit

 

●みなし再入国許可

 

　　一年以内に再入国はＯＫ　一年を超えて海外に在留すると資格は失われる。

There is no need to get the re-entry permission if the resident stay

outside Japan one year or under.

But if the resident stays over one year, he/she must get it.

 

●  海外で延長はできない。

It is not extended outside of Japan.

●  出国する際も、在留カードが必要

Zairyu-card is needed at the time of going out of Japan

●  日本の住居を引き払う場合は、区役所に届ければ良い？？？

If the resident gives up his apartment, he must report to

ward office.

 

今後の注意

パスポートは捨てない。(上陸の記録はこれのみ)

在留カードは常にコピーをとっておく。

現在の外国人登録証はコピーをとっておく。

 

 

Notes:

The residents must not do away with his passports for keeping record.

The residents must copy Zairyu-card for keeping record.

The residents must copy old Alien registration card for keeping record.
